Terms and Conditions

1. Organizer

The organizer of the contest is Pentland Brands Deutschland GmbH (hereinafter “Organizer”).

2. Eligibility

Eligible to participate are natural persons who are at least 21 years of age and reside in Germany, Austria, or Switzerland. Employees of the Organizer, the agency Pascher+Heinz GmbH commissioned to conduct the contest, as well as other companies involved in the contest and their relatives are excluded from participation. Participation requires the complete and truthful provision of the requested information.

3. Entry Period

The contest begins on June 16, 2026, at 12:00 PM and ends on February 28, 2027, at 11:59 PM (entry deadline).

4. No cost

Participation in the contest is free of charge. No purchase is necessary.

5. Participation

To enter, participants must fully complete the entry form on the contest website at www.your-berghaus.com during the entry period. Participation requires the following mandatory information: first name, last name, email address. Upon successful registration for participation (hereinafter “Registration”), the participant will receive a confirmation via email. Multiple entries by the same person are prohibited. Participation via sweepstakes clubs, automated services, bots, scripts, or other service providers that commercially operate participation in sweepstakes is not permitted. In the event of a violation of these provisions or suspicion of manipulation, the organizer is entitled to exclude the participant in question from participation—even retroactively—and to cancel any tickets or prize claims already allocated.

6. Extra chance through referrals

After registering, each participant will receive a personalised referral link via email. For every new, independent and valid entry made via this referral link, the participant will receive an additional entry into the draw for the main prize (‘Extra Entry’). The number of Extra Entries is limited to a maximum of [5] per participant. The referral link must be actively shared by the participant themselves. No automated emails or other messages will be sent to the recipients of the link by the organiser or on its behalf. The systematic or automated distribution of the referral link (e.g. via bots, scripts or mass emails) is prohibited and entitles the organiser to exclude the participant and to cancel all extra tickets.

7. Optional additional prize draws

During the entry period, the organiser reserves the right to hold additional prize draws amongst all participants registered at that time. The winners of the additional prize draws will be selected at the end of each month. All provisions of these terms and conditions apply to the additional prize draws accordingly.

8. Grande Prize

The organiser will hold a prize draw among all participants for the following grand prize: The use of a Rocket Camper / MAN / TGE 4x4 for a period of twelve (12) months from the handover of the vehicle (hereinafter referred to as the “Prize”). This is a prize consisting of the right to use the vehicle. Ownership of the vehicle will not be transferred. The prize is not transferable to other persons and cannot be exchanged. There is no entitlement to a cash payment of the prize value. Any prize shown in images is not necessarily identical to the vehicle actually provided. Variations, particularly in model, colour, equipment and accessories, are possible. Depending on availability, the organiser reserves the right to provide a prize of equivalent value in place of the one described. In addition to the vehicle, the winner will receive a fuel card with a credit balance of EUR 5,000 (in words: five thousand euros) to cover fuel costs (diesel) for the vehicle. The fuel card may only be used to refuel the vehicle provided as part of the prize; use for other vehicles is not permitted. Any unused credit will lapse without replacement at the end of the twelve-month period of use; there is no entitlement to a cash refund of any remaining balance.

9. Terms and Conditions of Vehicle Use

The details of vehicle use – in particular handover, return, mileage limit, insurance, eligibility to drive and duties of care – are set out in a separate usage agreement to be concluded between the organiser and the winner. The winner must agree to this usage agreement before taking up the prize. If the winner does not agree to the terms of the usage agreement, the claim to the prize lapses; a new winner will be selected. Upon collection of the vehicle, the winner must hold a valid Class B driving licence and have at least two years’ driving experience, as well as present a valid identity card or passport.

10. Selection of winner

The winner will be selected by random draw from among all registered participants after the closing date for entries. The winner will be selected no later than two (2) weeks after the closing date for entries.

11. Notification of Win and Acceptane

The winner will be notified by email to the email address provided upon entry. The winner’s claim to the prize only arises if they confirm acceptance of the prize to the organiser within 10 working days of the notification being sent. If no response is received within this period or if the winner cannot be contacted via the contact details provided, a new winner will be selected. The organiser is not obliged to provide proof that the notification has been received.

12. Taxes

Any tax liabilities arising from the prize shall be borne by the winner.

13. Inability to provide the prize

If the prize cannot be provided, or cannot be provided on time, for reasons beyond the organiser’s control (in particular, delivery delays, insolvency of the partner organisation, or force majeure), the organiser is entitled to provide a prize of equivalent value. A cash alternative is excluded in this case as well. Further claims by the winner are excluded to the extent permitted by law.

14. Organiser’s Liability

The organiser shall be liable without limitation in cases of wilful misconduct and gross negligence, as well as for damages resulting from injury to life, limb or health, and in accordance with the provisions of the Product Liability Act. In the event of a breach of a material contractual obligation due to slight negligence, the fulfilment of which is essential for the proper conduct of the competition and on the observance of which the participant may regularly rely (cardinal obligation), the Organiser’s liability is limited to the typically foreseeable damage. Otherwise, the Organiser’s liability for slight negligence is excluded. These limitations of liability also apply in favour of the Organiser’s vicarious agents commissioned to conduct the competition.

15. Amendment and termination of the competition

The organiser reserves the right to amend, suspend or terminate the competition at any time without prior notice and without giving reasons if proper conduct cannot be guaranteed for technical or legal reasons or if there is suspicion of manipulation. This shall not give rise to any claims on the part of participants, unless the organiser is responsible for the reasons for the amendment or termination.

16. Legal recourse

No legal recourse is available in respect of the selection of the winner or any decisions made by the organiser in connection with the competition.

17. Governing law

Participation in the competition and these terms and conditions are governed exclusively by the laws of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

18. Data protection

Participants’ data will be processed and used with due care and in accordance with the statutory provisions on data protection. The personal data provided by participants will be processed for the purpose of organising and administering the competition and, where necessary, forwarded to the agency Pascher+Heinz, which has been commissioned to organise the competition, as well as to technical service providers involved in the competition.
